• You agree not to: (a) Generate, upload, or distribute content that is illegal, harmful, abusive, defamatory, obscene, or otherwise objectionable, including but not limited to deepfakes, sexually explicit or NSFW content, child sexual abuse material, or content that infringes upon the intellectual property rights of others; (b) Attempt to reverse engineer, decompile, or disassemble any part of the Service; (c) Use automated systems, such as bots, spiders, or scrapers, to access the Site or Service; (d) Interfere with or disrupt the Service or its connected servers and networks; (e) Infringe upon the intellectual property rights of others.

5. User Content

• Ownership and Responsibility: You retain ownership of any content, including images, text, or other materials, that you upload or generate using the Service ("User Content"). You are solely responsible for the User Content you create, upload, publish, or share through the Service.

6. License to See 3D AI

• By submitting User Content, you grant See 3D AI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and display such User Content for operating, improving, and promoting the Service.

7. Content Restrictions

• You agree not to upload, generate, or share User Content that: (a) Infringes on the intellectual property rights of others; (b) Violates any applicable laws or regulations; (c) Contains malware, viruses, or other harmful code; (d) Is misleading, false, or inaccurate.

8. Intellectual Property

12. Premium Access and Credits

• Upon payment, you will receive one month of Premium Access, granting additional features and privileges within the Service. You will also receive 1 month of Credits, usable for specific functionalities or resources. Any new payment will automatically extend the duration of your Premium Access and Credits by the corresponding period associated with the new payment.

13. Refunds

• All fees are non-refundable unless otherwise stated. See3D.ART may, at its sole discretion, provide refunds or credits in specific circumstances.

14. Termination and Enforcement

• You may terminate your account at any time by following the instructions on the Site. Upon termination, your right to access and use the Service will cease immediately. 14.2 Enforcement Levels: We implement a tiered enforcement process for violations: - Minor or First-time Violations: A formal warning will be issued and temporary content restrictions may be applied. - Repeat Violations: Your account may be suspended for 7-14 days and any remaining credits may be forfeited. - Serious Violations (e.g., Child Sexual Abuse Material, terrorism-related content): Your account will be terminated immediately and permanently, your IP address and payment methods may be blacklisted, and we may report such activities to relevant law enforcement agencies without prior notice.

15. Termination by See3D.ART

• See3D.ART may terminate or suspend your account or access to the Service, with or without notice, for any reason, including violation of these Terms and in accordance with the enforcement levels described above.

16. Effect of Termination

• Upon termination, all licenses granted to you under these Terms will terminate, and you must cease all use of the Service. Any accrued rights or obligations, including those related to payment and intellectual property, will survive termination.

17. Disclaimers and Limitation of Liability

• The Service is provided "as is" and "as available" without any warranties, express, implied, or statutory. See 3D AI does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, See 3D AI disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

18. Limitation of Liability

• To the maximum extent permitted by law, See 3D AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the Service, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages.

19. Indemnification and Content Reporting

• You agree to indemnify, defend, and hold harmless See3D.ART, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising from your use of the Service, violation of these Terms, or infringement of any third-party intellectual property or other rights. Content Reporting & Takedown: Users or third parties may report potentially illegal or infringing content to [email protected]. Reports are triaged by our Trust & Safety team within 24 hours of receipt. If a report is found valid for infringement or privacy violation, the content will be removed within 12-48 hours. Users may appeal a moderation/takedown decision by submitting counter-evidence to the same email address.
